Mistrial Declared in Trooper McAcy Fatal Crash After Jury Deadlock

A mistrial has been declared in the case stemming from the death of Nebraska State Trooper Kyle McAcy.  A Cass County jury was unable to reach a unanimous verdict Friday, deadlocking 3-3 in the case against 57-year-old Thomas Jordan of Palmyra.

The split decision resulted in a mistrial, leaving the next step in the hands of the Cass County Attorney, who must now decide whether to retry the case. The charges stem from a February 17, 2025 crash on Interstate 80 near Ashland during snowy conditions.

Authorities say Trooper McAcy was responding to an earlier crash involving a Nebraska Department of Transportation snowplow and two passenger vehicles when he was fatally injured. According to investigators, one vehicle had struck the rear of the snowplow as it was clearing the interstate.

Trooper McAcy and another trooper arrived at the scene around 9:20 that morning. While one trooper assisted a driver who had come to rest in a ditch, McAcy was speaking with the snowplow operator, later identified as Jordan.

Investigators believe Trooper McAcy was asking Jordan to move the snow plow. As McAcy returned to help others, NSP said the plow reversed and hit him. McAcy died at the scene.
