Man Arrested After Police Struggle at South Lincoln Arby’s

Lincoln Police say a call to 911 sent officers to the Arby’s near 27th and Nebraska Parkway around 10:00 Tuesday night.  Sergeant Chris Vollmer says during the call a dispatcher could hear what sounded like a man and woman fighting. “First arriving officers located the caller, identified as 36-year-old Joseph Bertolino of Jacksonville, Florida, in the restroom,” says Sergeant Chris Vollmer.

“The officer made contact with Bertolino in the restroom, and a struggle ensued.” During the struggle, Vollmer says Bertolino grabbed for the officer’s sidearm. “At some point during the struggle, a round was discharged, striking the restroom floor.”

Additional officers arrived moments later, and a Taser was deployed. Bertolino was then taken into custody. Vollmer says Bertolino was taken to the hospital for evaluation following the Taser deployment.  The officer was also taken to the hospital for treatment after being struck in the leg by bullet fragments.

Bertolino was cited and booked into jail for attempted first-degree assault on an officer.
